Terms and Conditions
1. Scope of Application
1.1
Mambog B.V., Verdunplein 17 - Unit A4884, 5627 SZ Eindhoven, Netherlands, operates an online portal for the sale of Kratom at http://www.kratom.eu (hereinafter referred to as "Online Shop").
These Terms and Conditions apply to all deliveries to consumers based on orders placed in the Online Shop.
1.2
A consumer within the meaning of these Terms and Conditions is any natural person who concludes a legal transaction for purposes that predominantly are outside his trade, business, or profession.
2. Conclusion of Contract
2.1
The product presentations in the Online Shop serve as an invitation to make a purchase offer. By clicking the "Order with obligation to pay" button, you submit a binding purchase offer.
2.2
Acknowledgement of receipt of your order is sent via an automated email immediately after your order is submitted; this does not yet constitute acceptance of your offer.
We may accept your offer (your order) by sending a separate order confirmation by email or by delivering the goods within 7 days of receiving your order.
3. Prices and Payment Terms
3.1
The prices indicated on the product pages include VAT. Applicable taxes and packaging costs are also included in the displayed prices.
3.2
Our prices do not include shipping costs, customs duties, postage, insurance premiums, or other additional costs.
3.3
Current discounts and credit promotions can be viewed at any time under "Promotions" in the Online Shop.
3.4
Payment for the goods is made in advance (bank transfer), cash on delivery, or - under the conditions listed below - by invoice. The following provisions remain unaffected.
The currently available payment methods are listed under "Payment Options" in the Online Shop. Only the payment options shown during the checkout process are accepted.
We reserve the right to exclude or restrict individual payment methods.
3.5
Unless otherwise agreed, payment must be made in advance (bank transfer). If paying in advance, you are obliged to pay the purchase price immediately and no later than 10 days after the conclusion of the contract.
Payment information is included in the order confirmation.
3.6
If you choose cash on delivery, the purchase price must be paid upon receipt of the goods.
3.7
Payment by invoice is available starting with your 11th order. If selected, payment must be made within 10 days of the invoice date.
4.Shipping Costs
5. Delivery Conditions
5.1
Delivery time is 1-7 days unless otherwise stated in the product description.
5.2
The delivery period begins, depending on the chosen payment method, upon receipt of payment (for advance payment), confirmation of payment, or upon dispatch of our order confirmation (for cash on delivery or invoice).
5.3
If not all ordered products are in stock, we are entitled to make partial deliveries at our expense, provided this is reasonable for you.
5.4
If delivery fails due to your fault despite three attempts, we may withdraw from the contract. Any payments made will be refunded promptly.
5.5
If the ordered product is permanently unavailable because we are not supplied with this product by our supplier through no fault of our own, we may withdraw from the contract. In this case, we will inform you immediately and suggest a comparable product if available.
If no comparable product is available or you do not wish to receive a comparable product, we will refund any consideration already provided without delay.
If we are temporarily prevented from fulfilling our contractual obligations due to force majeure or other circumstances beyond our control, the deadlines specified in or based on the contract shall be extended accordingly. In this case, we will inform you promptly and indicate the expected delay.
5.6
Delivery and transfer of risk occur upon handover of the shipment to you. Delivery is considered fulfilled with respect to meeting the delivery time if a delivery attempt occurred at a time when you could reasonably expect it.
6. Right of Withdrawal
6.1
As a consumer, you have the right to withdraw from the contract within 14 days.

You may revoke your contractual declaration within 14 days without stating any reasons in text form (e.g., letter, fax, email) or โ if the goods are delivered before the deadline โ by returning the goods.

Consequences of Withdrawal
In the event of a valid withdrawal, both parties must return any received services and surrender any benefits derived (e.g., interest). If you cannot return the received goods or services or only in a deteriorated condition, you must compensate us for the value lost. Shipping costs or other fees will not be refunded. The customer bears the return shipping costs.
6.2
The right of withdrawal does not apply to distance contracts for the supply of goods that are made to the consumer's specifications or clearly personalized, that are not suitable for return due to their nature, may spoil quickly, or would exceed their expiry date.
6.3
We kindly ask you to return the goods as a prepaid parcel and keep the receipt. We will gladly reimburse you in advance for the return shipping costs if these are not to be borne by you. Prepaid return is a condition for the effective exercise of the right of withdrawal.
7. Agreement on Return Shipping Costs
If you exercise your right of withdrawal, you must bear the regular return shipping costs.
8. Retention of Title
The goods remain our property until full payment of the purchase price. While the retention of title applies, you may not dispose of the goods or grant third parties any contractual usage rights. In particular, you may not pledge, assign as security, process, or transform the goods without our consent.
9. Liability and Warranty
9.1
We are only liable for damages โ excluding any further liability โ if:

we breach essential contractual obligations at least negligently,

we breach contractual obligations at least negligently resulting in injury to life, body, or health, or
-
we intentionally or grossly negligently breach other contractual obligations.
The provisions of the Product Liability Act remain unaffected.
9.2
The warranty is provided in accordance with statutory provisions.
10. Set-off, Right of Retention, and Assignment
10.1
Set-off is only permitted with undisputed or legally established claims.
10.2
The right of retention may only be exercised based on claims arising from this contractual relationship.
10.3
Your claims against us may not be assigned to third parties without our express written consent.
11. Use of the Goods
By placing a binding order, you confirm that the goods ordered will not be used for consumption but solely for cosmetic, colorant, collection, or research purposes.
12. Final Provisions
12.1
The law of the Netherlands shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
12.2
Any changes or additions to the purchase or delivery contract must be confirmed by us in writing to be effective; this also applies to the requirement for written form itself.
12.3
Jurisdiction is our registered office.
12.4
If any provision of these Terms and Conditions is or becomes invalid, the relevant statutory provisions shall apply in its place.
